Judge Fitzgerald was elected to Third Circuit Court of Appeal in Louisiana, in November 2020 and took the bench on January 1, 2021. 

Prior to taking the bench, Judge Fitzgerald was a partner in the firm Cox Fitzgerald, L.L.C., where his practice focused in the family law area, with emphasis on divorce, custody, support, and community partition matters, and litigation in those areas. He is trained in Collaborative Law, and has given presentations on various family law issues to the Society of Louisiana Certified Public Accountants, the National business Institute, and the Lafayette Bar Association. 

Judge Fitzgerald is a 1992 graduate of the Episcopal School of Acadiana.  He earned a Bachelor of Science degree in Microbiology from Louisiana State University in 1997.  He received his Juris Doctorate degree in 2001 from the Louisiana State University Paul M. Hebert Law Center, graduating in the top 5% of his class (Louisiana Law Review and Order of the Coif).

In October of 2001, Judge Fitzgerald was admitted to the Bar of the State of Louisiana.  Since that time, he has been admitted to practice before the U.S. Fifth Circuit Court of Appeals; U.S. District Courts for the Eastern, Middle, and Western Districts of Louisiana; and U.S. Bankruptcy Court for the Western District of Louisiana.  He is a member of the Federal Appellate Bar Association, Federal Bar Association, Louisiana State Bar Association, and Lafayette Bar Association, including its Paula K. Woodruff Family Law Section.  He is also a member of the American Inn of Court of Acadiana.

Judge Fitzgerald and his wife have been married for 11 years, and they are the parents of three children.  Judge Fitzgerald enjoys coaching soccer, playing golf, and spending as much time as possible with his family.
